Terms and Conditions Airport.nl
Article 1. General and Applicability
- These Terms and Conditions apply to every visitor and customer (hereinafter: the "Customer") of the Airport.nl platform (hereinafter: the "Platform") and to all services offered by Airport.nl.
- Airport.nl’s services primarily consist of mediating the reservation of parking spaces (the "Mediation Service") and related services.
- By placing a reservation through the Platform, the Customer unconditionally agrees to these Terms and Conditions.
- The applicability of any terms and conditions of the Customer or third parties is expressly rejected.
- Airport.nl reserves the right to unilaterally amend these terms. The most current version is always available on the Platform.
Article 2. The Service (Role of the Platform)
- Airport.nl provides an online platform where Customers can compare and reserve parking spaces.
- Mediation: Airport.nl is explicitly not a party to the ultimate parking agreement. Once the Customer makes a reservation, a direct agreement (the "Parking Agreement") is concluded between the Customer and the relevant parking provider (the "Provider").
- Airport.nl is not responsible for the performance of the Parking Agreement, the quality of the parking space or the safety of the vehicle.
- The information on the Platform (such as rates, availability and facilities) is provided by the Providers. While Airport.nl aims to display this accurately, we depend on the accuracy of third-party information.
- Exclusion of right of withdrawal: Because the service concerns leisure services and/or capacity reservations for a specific date, the statutory right of withdrawal (14-day cooling-off period) does not apply to reservations made via Airport.nl (pursuant to Dutch Civil Code art. 6:230p).
- If the Customer books additional services via the Platform (such as insurance), Airport.nl merely acts as an intermediary. The Customer enters into a contract with the relevant partner for such services.
Article 3. The Reservation Process
- After completing the booking, the Customer will receive a reservation confirmation by email (the "Voucher").
- The Voucher contains essential information, including:
- The contact details and address of the Provider;
- Arrival instructions (and for Valet Parking: the handover location);
- The payment status and the rate.
- The Customer must check the details on the Voucher immediately upon receipt. If the email has not been received within one hour, the Customer must contact Airport.nl customer service (and check the spam folder).
Article 4. Obligations of Airport.nl
- Airport.nl strives to ensure smooth mediation and to display correct information about Providers.
- Airport.nl carefully selects Providers but cannot be held liable for the content of information supplied by them, unless there is gross negligence on the part of Airport.nl.
- If Airport.nl is notified of incorrect information, we will make reasonable efforts to correct it as soon as possible.
Article 5. Obligations of the Customer
- The Customer is responsible for providing correct details (email, license plate, flight times) during the booking process.
- The Customer must be at least 18 years of age to make a reservation.
- The Customer is responsible for arriving at the Provider on time. Airport.nl is not liable for missed flights due to delays en route or at the parking location.
- The Customer must be able to present the Voucher (digital or printed, depending on the Provider’s requirements) upon arrival.
- Changes to the arrival time must be communicated by the Customer to the Provider in good time via the phone number on the Voucher.
Article 6. Rates and Payment
- Displayed rates include VAT unless stated otherwise.
- Rates are dynamic and may fluctuate based on availability, season and time of booking. The price at the moment of booking is binding.
- Payment is usually made directly online via the Platform. In some cases (if indicated), the Customer pays (part of) the amount on site to the Provider.
- Airport.nl is entitled to charge reservation or administrative fees.
- Any additional fees charged by the Customer’s bank for transactions (e.g. foreign currency) are the Customer’s responsibility.
Article 7. Cancellation and No-Show
- In most cases, the Customer may cancel free of charge up to 24 hours before the reservation start time, unless the product specifically states ‘Non-Refundable’.
- For cancellations within 24 hours before the start, Airport.nl is entitled to charge (or not refund) the full reservation amount.
- Cancellations must be made via the Airport.nl online environment or via the link in the confirmation email.
- Any transaction fees paid at the time of booking are non-refundable.
- No-Show: If the Customer does not show up without timely cancellation, or leaves earlier than planned, there is no right to a refund of parking costs.
- If the Provider refuses the vehicle because it does not meet the conditions (e.g. vehicle too large, while this was clearly indicated), the payment obligation remains.
Article 8. Reviews, Ranking and Content
- Airport.nl aims for a transparent platform. The order in which Providers are displayed (Ranking) is by default determined by price (low to high) but can be adjusted by the Customer using filters.
- Airport.nl reserves the right to change the default sorting to improve user experience.
- Reviews on the Platform are checked for authenticity. Airport.nl reserves the right to remove reviews or content that violate the law, are discriminatory or contain inaccuracies.
- The Customer is not permitted to use the Platform for illegal purposes, fraud or the distribution of viruses. In case of abuse, Airport.nl may block the account and deny access.
Article 9. Privacy
- Airport.nl processes personal data in accordance with the General Data Protection Regulation (GDPR).
- The Customer guarantees that the personal data provided are correct.
- Airport.nl only shares necessary data with the Provider to enable the reservation.
- For a complete overview of data processing, please refer to our Privacy Policy on the website.
Article 10. Liability
- Limitation: Airport.nl only mediates. We are not liable for damage arising from the performance of the Parking Agreement. This includes, but is not limited to: damage to the vehicle, theft, burglary or personal injury on the Provider’s premises.
- Airport.nl is not liable for indirect damages, consequential damages, loss of profit or missed flights.
- Airport.nl’s liability is in all cases limited to a maximum of the amount the Customer paid for the reservation, or (if higher and applicable) the amount paid out under Airport.nl’s business liability insurance.
- The exclusions of liability do not apply in cases of intent or willful recklessness by the management of Airport.nl.
Article 11. Force Majeure
- In the event of force majeure, Airport.nl is not obliged to fulfill its obligations. Force majeure means any circumstance beyond Airport.nl’s control that reasonably prevents performance (e.g. internet/telecom outages, fire, government measures or technical failures of the Platform).
- During the force majeure situation, Airport.nl’s obligations are suspended.
Article 12. Complaints Procedure
- Platform-related complaints: Complaints about the booking process or the website must be reported to Airport.nl customer service as soon as possible. We aim to respond within 14 days.
- Parking-related complaints: Complaints about the parking service, damages or the shuttle must be reported directly on site to the Provider. The Customer must follow the Provider’s instructions.
- Although Airport.nl is not responsible for the parking service, we may mediate in disputes in some cases, without any rights being derived from such mediation.
- Submitting a complaint does not relieve the Customer of the payment obligation.
Article 13. Final Provisions
- If any provision of these terms is found to be null and void, the remaining provisions will remain in full force and effect.
- These terms and any disputes arising from Airport.nl’s services are governed exclusively by Dutch law.
- The Vienna Sales Convention (CISG) is excluded.
- Disputes will be submitted to the competent court in the district where Airport.nl has its statutory seat, unless mandatory consumer law designates another court.
